How Can I File An Appeal?

There are two avenues for immigration appeals. The one you pursue depends on your unique circumstances. The options include:

  1. Filing an appeal with the Administrative Appeals Office (AAO), which handles appeals of determinations made by the USCIS such as employment visas, family visas and more. You must file your appeal within 30 days.
  2. Filing an appeal with the Board of Immigration Appeals (BIA), which handles verdicts made by immigration judges, including final removal proceedings and asylum cases. You must also file these within 30 days.

If the AAO or the BIA issue an unfavorable decision, you may still have hope: You can file with a federal court of appeals or the United States District Court. As litigators, we are prepared to pursue this option aggressively with the knowledge that your future depends on our success.
